I have a contract between myself and the owner of a female Boxer.  This contract states that she is to give me $500 when she sells her first puppy since she did not have the money upfront.  The Female went into labor early and no puppies survived.  Do I still ask her for the money or what is the etiquet.

A contract should always spell out every eventuality.  From how many pups are considered a litter, what happens if the dam miscarries, to the obligation of you the stud owner if the dam doesn't take.


My questions would be, what caused the female to miscarry? Were both dogs tested prior to breeding to ensure neither carried anything transferable?  If she lost her litter due to negligence on the owners part, I would ask for half the fee.

If the contract reads "when she sells a pup" and none where sold, then you are out of luck.  In the future I would amend your contact because what if the owner of the female "gave them all to friends" you would be out again.

Consider this a lesson learned.
