My puppy is 16weeks old now and he weighs 39.5oz (3pounds) and his height now at the shoulder is a bit over 7inches. The shop I bought him from said he is miniature but from what i am reading on the internet it seems this is in line with a toy size?
Now that she has the size wrong, I wonder if the pedigree bit is also genuine? Is there a way to check?

Well first you would have to figure out if these people at this store ever know what the difference between toy and miniature is.  A LOT of people out there think that miniature is smaller than toy.  So maybe they are confused there.  SO I would go back and asertain that.  If they truely do know the difference then you only recourse to know if the papers are geuine would be if it is AKC or UKC papers.  Then you can have a paternity test done to make sure the puppy matches the parents listed on the papers.  If the dog is NOT AKC or UKC then there is no way to know.  Looks like your dog at 16 weeks is very small for even a toy in height.  Weight really has nothing to do with poodles since its height restrictions that are used to define the varities not weight.
You also have to rememeber too that there have been a lot of crossing of the lines between the varities making it even harder to tell what size any given puppy will be when fully mature.  That is the problem with purchasing from stores and not going to a reputable breeder that knows their lines and their dogs.
